Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of the website emeraldluxelimo.com (the "Site") and all limousine, livery, chauffeur, and ground transportation services (collectively, the "Services") provided by Emerald Luxe Limo ("Emerald Luxe Limo," "we," "us," or "our").

By booking, using, or accessing our Services or Site, you ("Client," "Customer," "you," or "your") agree to be legally bound by these Terms. If you do not agree, do not use our Site or Services.

1. Acceptance of Terms

By submitting a reservation, paying a deposit, signing a booking confirmation, or using our Services in any way, you confirm that you have read, understood, and agreed to these Terms on behalf of yourself and all passengers in your party. You represent that you are at least 18 years of age and have the legal authority to enter into this agreement.

2. Reservations and Bookings

All reservations are subject to vehicle availability and confirmation by Emerald Luxe Limo. A reservation is not confirmed until you receive a written confirmation from us. We reserve the right to refuse, cancel, or modify any reservation at our sole discretion. The Client is responsible for providing accurate pickup locations, times, contact information, flight details, and any special requirements at the time of booking.

3. Payment Terms

A deposit may be required to secure your reservation. The remaining balance is due before or at the time of service unless otherwise agreed in writing. We accept major credit cards and other payment methods listed at checkout. By providing payment information, you authorize us to charge the agreed amount, plus any applicable taxes, gratuities, tolls, parking fees, wait time charges, cleaning fees, damage fees, or additional charges incurred during your trip. Declined or disputed charges may result in immediate suspension of Services and collection action, and you agree to pay all costs of collection, including reasonable attorneys' fees.

4. Cancellation and No-Show Policy

Cancellations must be made in writing (email or text) at least twenty-four (24) hours before the scheduled pickup time. Cancellations made less than 24 hours before the scheduled pickup time, and all no-shows, will be charged the full amount of the reserved trip, including gratuity, tolls, and any prepaid expenses. "No-show" means the passenger fails to appear at the designated pickup location within a reasonable grace period. Emerald Luxe Limo is not responsible for missed pickups caused by incorrect information provided by the Client, including wrong addresses, flight numbers, or contact details. Deposits are non-refundable for late cancellations and no-shows.

5. Changes and Modifications

Any changes to a confirmed reservation, including time, route, stops, vehicle type, or passenger count, must be requested in writing and are subject to availability and additional charges. We will make reasonable efforts to accommodate changes but cannot guarantee them.

6. Wait Time, Stops, and Overtime

A reasonable grace period may apply for pickups. Wait time beyond the grace period, unscheduled stops, route changes, and overtime beyond the booked duration will be charged at our prevailing hourly or per-incident rates. The Client authorizes Emerald Luxe Limo to charge the credit card on file for these additional charges.

7. Passenger Conduct and Vehicle Rules

The Client is responsible for the conduct of all passengers. The following are strictly prohibited inside our vehicles:

  • Smoking, vaping, or use of any tobacco products.

  • Use of illegal drugs or controlled substances.

  • Consumption of alcohol by anyone under the legal drinking age.

  • Possession or use of firearms, weapons, or hazardous materials.

  • Standing through sunroofs, hanging out of windows, or any unsafe behavior.

  • Damaging, defacing, or tampering with the vehicle or its equipment.

  • Harassment, threats, or violence toward the chauffeur or other passengers.

  • Carrying more passengers than the vehicle's licensed seating capacity.

Emerald Luxe Limo and its chauffeurs reserve the right to refuse service, end the trip immediately without refund, and remove passengers from the vehicle at any time if these rules are violated, if passengers are visibly intoxicated to the point of safety risk, or if the chauffeur reasonably believes their safety or the safety of others is at risk. Law enforcement may be contacted at our discretion.

8. Damage, Cleaning, and Repair Fees

The Client is fully responsible for any damage to the vehicle or its interior caused by the Client or any passenger in the party, whether intentional or accidental. The following minimum fees apply and may be charged to the credit card on file without further notice:

  • Interior cleaning (spills, stains, mud, food debris): starting at $250

  • Vomit / bio-cleanup ("sickness fee"): starting at $500

  • Smoking or vaping inside the vehicle: starting at $500

  • Burns to upholstery, carpet, or trim: starting at $750

  • Broken glassware, electronics, or fixtures: repair or replacement cost plus labor

  • Damage requiring repair or downtime: full repair cost plus loss-of-use compensation

Actual damages may exceed these minimums, and the Client agrees to pay the full cost.

9. Lost and Found

Emerald Luxe Limo is not responsible for items left behind in any vehicle. We will make a reasonable effort to return found items at the Client's expense, but we make no guarantee of recovery and accept no liability for lost, stolen, or damaged personal property.

10. Delays, Traffic, and Force Majeure

Emerald Luxe Limo is not liable for delays, missed flights, missed connections, missed events, or any other consequences caused by traffic, weather, mechanical failure, accidents, road closures, acts of God, government actions, strikes, pandemics, civil unrest, or any other event beyond our reasonable control. The Client is responsible for booking with sufficient buffer time to account for reasonable delays.

11. Vehicle Substitution

We reserve the right to substitute a vehicle of equal or greater value, comparable comfort, and similar capacity if the originally reserved vehicle becomes unavailable for any reason, including mechanical issues, prior trip overruns, accidents, or scheduling conflicts. Vehicle substitution does not entitle the Client to a refund or discount.

12. Luggage and Personal Items

Luggage is limited by the capacity of the vehicle. Oversized items must be disclosed at the time of booking. Emerald Luxe Limo is not responsible for damage to luggage, fragile items, or improperly packed goods. The Client transports all personal property at their own risk.

13. SMS and Communications

By providing your phone number, you agree to receive calls and SMS/text messages from Emerald Luxe Limo regarding your booking, service updates, and (where you have opted in) promotional offers. 14. Disclaimer of Warranties

To the fullest extent permitted by law, our Site and Services are provided "as is" and "as available," without warranties of any kind, whether express, implied, statutory, or otherwise. Emerald Luxe Limo disclaims all warranties including but not limited to merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, availability, and uninterrupted service. We do not warrant that the Site will be error-free or that any defects will be corrected.

15. Limitation of Liability

To the maximum extent permitted by law, Emerald Luxe Limo, its owners, officers, employees, chauffeurs, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to lost profits, lost income, lost opportunities, missed flights or events, loss of goodwill, loss of data, emotional distress, or personal inconvenience, even if we have been advised of the possibility of such damages.

In any event, the total aggregate liability of Emerald Luxe Limo arising out of or related to your use of our Services or Site shall not exceed the amount you actually paid to Emerald Luxe Limo for the specific trip or Service giving rise to the claim. This limitation applies regardless of the legal theory under which the claim is brought (contract, tort, negligence, strict liability, or otherwise).

Some jurisdictions do not allow the exclusion or limitation of certain damages; in such cases, our liability shall be limited to the smallest amount permitted by law.

16. Indemnification

You agree to defend, indemnify, and hold harmless Emerald Luxe Limo, its owners, officers, employees, chauffeurs, agents, contractors, and affiliates from and against any and all claims, demands, damages, losses, liabilities, judgments, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of our Services or Site; (b) your breach of these Terms; (c) the conduct or actions of any passenger in your party; (d) any damage caused to our vehicles or property; (e) your violation of any law or the rights of any third party.

17. Insurance

Emerald Luxe Limo maintains commercial automobile insurance as required by applicable state law. Coverage is limited to the terms and limits of our policy. We are not responsible for personal injury, property loss, or any damages exceeding the limits of our insurance coverage except where required by law.

18. Intellectual Property

All content on our Site, including text, logos, images, vehicle photos, branding, graphics, and design, is the property of Emerald Luxe Limo or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, modify, or use any content from our Site without our prior written consent.

19. Third-Party Services

Our Site may link to or integrate with third-party services (such as payment processors, booking platforms, or communication providers). We are not responsible for the content, accuracy, availability, or practices of any third-party services. Your use of third-party services is governed by their own terms.

20. Privacy

Your use of our Site and Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to the data practices described in the Privacy Policy.

21. Governing Law and Jurisdiction

These Terms and any disputes arising out of or relating to them, our Site, or our Services shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of laws principles. You agree that any legal action, claim, or proceeding shall be brought exclusively in the state or federal courts located in King County, Washington, and you consent to the personal jurisdiction of such courts.

22. Dispute Resolution and Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or our Services shall first be attempted to be resolved through good-faith negotiation. If unresolved within thirty (30) days, the dispute shall be resolved by final and binding arbitration administered by a recognized arbitration provider (such as the American Arbitration Association) under its applicable rules. Arbitration shall take place in King County, Washington, and shall be conducted in English. Judgment on the arbitration award may be entered in any court of competent jurisdiction.

Class Action Waiver: You and Emerald Luxe Limo agree that any dispute shall be brought solely in an individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, or representative action. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

Jury Trial Waiver: To the fullest extent permitted by law, you and Emerald Luxe Limo waive any right to a trial by jury in any action arising out of or relating to these Terms or our Services.

23. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.

24. Entire Agreement

These Terms, together with our Privacy Policy and any written booking confirmation, constitute the entire agreement between you and Emerald Luxe Limo regarding your use of our Services and supersede all prior or contemporaneous communications, proposals, or agreements, whether oral or written.

25. No Waiver

Our failure to enforce any provision of these Terms shall not be deemed a waiver of that provision or any other provision. No waiver is effective unless made in writing and signed by an authorized representative of Emerald Luxe Limo.

26. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Emerald Luxe Limo may assign these Terms at any time without notice.

27. Changes to These Terms

We may update these Terms at any time. The updated version will be posted on this page with a new "Last Updated" date. It is your responsibility to review these Terms periodically. Your continued use of our Site or Services after any changes are posted constitutes your acceptance of the updated Terms.
